Introduction

Linkvite respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy for the removal of infringing content and the termination of users who are repeat infringers.

If you believe that your copyright has been infringed upon via our platform, you may submit a written notice to our designated Copyright Agent containing the following information:

  1. Your Physical or Electronic Signature: Confirmation of your identity as the copyright owner or a person authorized to act on their behalf.

  2. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed upon.

  3. Identification of the Infringing Material: A description of where the material that you claim is infringing is located on our platform, sufficient for Linkvite to locate the material.

  4. Contact Information: Your address, telephone number, and email address.

  5. Good Faith Belief Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. Accuracy Statement: A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Misrepresentation Warning

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees. Filing a false DMCA notice can result in serious legal consequences.

Counter-Notification Procedures

If you believe that your content that was removed or to which access was disabled is not infringing, or that you have the authorization from the copyright owner, its agent, or the law to post and use the material, you may send a counter-notice containing the following information to our Copyright Agent:

  1. Your Physical or Electronic Signature.

  2. Identification of the Material: Description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

  3. Statement Under Penalty of Perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

  4. Your Contact Information: Address, telephone number, and, if available, email address.

  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Linkvite may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Upon receipt of a valid counter-notice, Linkvite will follow the DMCA procedures to reinstate the material in question.

Policy Modifications and Amendments

Linkvite reserves the right to modify the terms of this policy at any time. Changes will be posted on our website along with the updated effective date.

Jurisdiction

This policy is subject to the laws of the State of Delaware.
